NINJA POINT APP PRIVACY POLICY

This Privacy Policy applies to services provided by us and sets out how we may collect, use and disclose information for your access to and use of Ninja Point services to schedule pick-ups and drop offs at our Ninja Point retail outlets in connection with the online transactions for products or services concluded on and through e-commerce platforms provided by Ninja Van, including www.ninjavan.co (“Ninja”), collect.ninjavan.co (“Ninja Collect"), Ninja Point mobile app, or other websites (collectively, “Ninja Sites”).

Ninja Point is the easiest way to collect your online purchases. Now you can pick up or drop off parcels at our Ninja Point retail outlets when it suits you. Our Ninja Point app saves you the hassle of missed deliveries and or waiting for your parcels. 

COLLECTION OF INFORMATION

We have taken steps to ensure that we do not collect more information from you than is necessary for us to provide you with our services and to protect your account.
Information including, but not limited to, your name, date of birth, address, phone number, passwords and email address ("Registration Information") may be collected at the time of user registration on the App and/or Site (“Ninja Point”) through which Ninja provides services to you.
As a condition of providing users with delivery, or other services via the Ninja Point app, your precise location data must be provided to Ninja Point via the App and/or Site that you use. Once the Ninja App and/or Site has permission to access location services through the permission system used by your mobile operating system (“platform”), we will collect the precise location of your device when the App and/or Site is running. We may also derive your approximate location from your IP address.
We collect transaction details related to the delivery (or other) services through our platform, including the type of service provided, date and time the service was provided, amount charged, distance traveled, and other related transaction details. 
Our Services require us to access your device’s camera. The camera function is to scan barcodes. 
We collect information about how you interact with our Services, preferences expressed, and settings chosen. In some cases we do this through the use of cookies, pixel tags, and similar device identification technologies that create and maintain unique identifiers. 
Insofar and only insofar as Registration Information and Account Information constitute personally identifiable data of living individuals, such information are together referred to as personal data (“Personal Data”).


B. USE OF PERSONAL DATA

If you provide any Personal Data to us, you are deemed to have authorized us to collect, retain and use that Personal Data for the following purposes:
verifying your identity, including during account creation and password reset processes;
verifying your eligibility to register as a user of the Ninja Point App and/or Site;
processing your registration as a user, providing you with a log-in ID for the Ninja Point App and/or Site and maintaining and managing your registration;
providing you with Ninja Point service and related customer service (including but not limited to shipping and related services for purchases made using Ninja Point services, sending notices about your transactions, and responding to your queries, feedback, claims or disputes) by placing a voice call or through text (SMS) or email messaging;
performing research or statistical analysis in order to improve the content and layout of the Ninja Point App and/or Site, to manage and protect our information technology infrastructure, to measure the performance of Ninja Point services and to improve our product offerings and services;
subject to obtaining your consent under applicable laws, we may use your name, phone number (by placing a voice call or through text (SMS)), residential address and email address ("Marketing Data") to provide notices, surveys, product alerts, communications and other marketing materials or promotional offers to you relating to services offered by us on the Ninja Point App and/or Site;
managing risk, performing creditworthiness and solvency check (and comparing information for accuracy and verify it with third parties) or assessing, detecting, preventing, and/or remediating fraud or other potentially prohibited or illegal activities;
detecting, preventing or remediating violations of policies or applicable user agreements;
making such disclosures as may be required for any of the above purposes or as required by law, government officials or other third parties pursuant to a subpoena, court order, or other legal process or requirement applicable to Ninja Point or one of its affiliates, or when we need to do so to comply with law (including but not limited to anti-money laundering and counter-terrorist financing verification requirements) or credit card rules; or when we believe, in our sole discretion, that the disclosure of Personal Data is necessary to prevent physical harm or financial loss, to report suspected illegal activity or in respect of any claims or potential claims brought against us.

C. DISCLOSURE OF PERSONAL DATA

You further agree that we may disclose and transfer your Personal Data to service providers engaged by us ("Service Providers") or financial institutions that we partner with to assist us with providing you with our services (including but not limited to fraud prevention, bill collection, data entry, database management, promotions, marketing, customer service, technology services, products and services alerts and payment extension services).
You agree that we may disclose and transfer (whether within or outside the jurisdiction of the Ninja Point entity that you are contracting with), for the purposes specified at B.1 to B.9 above, your Account Information and Personal Data to affiliates of Ninja Point or other affiliated companies within the Ninja Group, which comprises a group of companies operating leading online and mobile marketplaces in consumer and business-to-business commerce, as well as cloud computing and other services, such as where Ninja Point has placed a hold or other restriction on your account based on disputes, claims, chargebacks or other scenarios regarding the sale or purchase of goods or for evaluation of buyers or sellers on their respective platforms (including “whitelisting” - specifically identifying the trusted users).
When necessary, we may also disclose and transfer your Personal Data to our professional advisers, law enforcement agencies, insurers, government and regulatory and other organizations for the purposes specified at B.9 above. Please note that as some of these entities may be located in a country or territory other than Singapore, this may involve your Personal Data requiring to be transferred to a country or territory outside Singapore, when this is in the legal or business interests of Ninja Point. By agreeing to this privacy policy, you hereby consent to such transfers.
We may share your Account Information and Personal Data with banks or Service Providers to enable your transactions on the Ninja Point App and/or Site to be completed. In addition, we may use your Account Information and Personal Data to prevent fraud or assess and manage risk or evaluate your credit-worthiness and associated risks or protect your account from fraudulent activity (and alert you if we detect such fraudulent activity on your accounts) and, in the process of such determination, we may need to make such Account Information and Personal Data available to Service Providers, banks, collection agent or credit agencies.
We may share your Personal Data with banking partners as required by credit card association rules for inclusion on their list of terminated merchants (in the event that you meet their criteria which includes having Ninja Point close your Ninja Point account due to your breach of applicable user agreement).
We may share your Personal Data with companies which we plan to merge with or are acquired by, which shall follow the terms and conditions of this Privacy Policy with respect to the use of your Personal Data.
We may provide statistical information to third parties, but when we do so, we do not provide personally-identifying information without your permission. We may also share your Personal Data with other third parties with your consent or direction to do so.
While we have in place up-to-date technology and internal procedures to keep your Account Information and other Personal Data secure from intruders, there is no guarantee that such technology or procedures can eliminate all of the risks of theft, loss or misuse.
Any Personal Data supplied by you will be retained by us and will be accessible by our employees, any Service Providers engaged by us and third parties referred to above, for or in relation to any of the purposes stated in B.1 to B.9 above, who will be under a duty of confidentiality to us and are only permitted to use your Personal Data in connection with the purposes specified at B.1 to B.9 above, and not for their own purposes (including direct marketing) unless you have given consent for other uses.

D. SECURITY MEASURES
We employ commercially reasonable security methods to prevent unauthorized access to the Ninja Point App and/or Site, to maintain data accuracy and to ensure the correct use of the information we hold. For registered users of the Ninja Point App and/or Site, your Registration Information and Account Information (if any) can be viewed and edited through your account, which is protected by a password. We recommend that you do not divulge your password to anyone. Our personnel will never ask you for your password in an unsolicited phone call or in an unsolicited email. If you share a computer with others, you should not choose to save your log-in information (e.g., user ID and password) on that shared computer. Remember to sign out of your account and close your browser window when you have finished your session. No data transmission over the internet or any wireless network can be guaranteed to be perfectly secure. As a result, while we try to protect the information we hold for you, we cannot guarantee the security of any information you transmit to us and you do so at your own risk.

E. CHANGES TO THIS PRIVACY POLICY
We may change this Policy from time to time. If we make significant changes in the way we treat your personal information, or to the Policy, we will provide you notice through the Services or by some other means, such as email. Your continued use of the Services after such notice constitutes your consent to the changes. We encourage you to periodically review this Policy for the latest information on our privacy practices.

F. JURISDICTION AND CHOICE OF LAW
This Agreement shall be interpreted, construed and enforced in all respects in accordance with the laws of the Republic of Singapore. You irrevocably consent to the exclusive jurisdiction of the courts of the Republic of Singapore, in connection with any action to enforce the provisions of this Agreement, to recover damages or other relief for breach or default under this Agreement, or otherwise arising under or by reason of this Agreement
